Eduardo Hallak is a founding partner at Licks Attorneys and leads the firm’s Sao Paulo office. With over a decade of experience, he has established himself as a prominent litigator in complex disputes and leading cases in Brazil.

Mr. Hallak specializes in litigation involving patent law, competition, and regulatory compliance, with a particular focus on the life sciences sector. He also has extensive experience in trademark litigation and technology transfer contracts, assisting multinational clients in establishing robust brand protection and licensing programs in Brazil.

As an educator, Mr. Hallak serves as a professor of IP litigation in the post-graduate program at the prestigious Pontifical Catholic University of Rio de Janeiro (PUC-Rio) and has taught Civil Procedure at the Brazilian Association of IP Agents (ABAPI). A frequent speaker on procedural and strategic aspects of IP litigation, he also serves as a member of the Special Commission on Mediation of the Rio de Janeiro Chapter of the Brazilian Bar Association (OAB-RJ) and the Enforcement Committee of the International Trademark Association (INTA).

  • Adama Makhteshim Ltd - These are leading cases resulting on the interpretation that BRPTO’s rule was illegally interpreting the Patent Statute in regard to the definition of the expression “the end of the examination”, which led to the rejection of divisional applications filed by Adama regarding one of its main products patent portfolio. Licks Attorneys represents Adama in several litigation defending its interests with regards with an agrochemical patent portfolio. Recently, the Federal Court of Appeals for the 2nd Circuit reverted two Trial Court decisions rejecting two patent applications with basis on an internal rule of the BRPTO illegally restricting the patentee’s right of filing divisional applications until the end of first level of analysis at the BRPTO.
