  • Lundbeck is the Defendant in three related nullity lawsuits (lawsuits #5084536-83.2020.4.02.5101, #5015034-23.2021.4.02.5101 and #5005543-89.2021.4.02.5101) pending before the 13th Federal Court of Rio de Janeiro, aiming the nullity of the patents PI 0212733-4 and BR 12 2012 023120-7, owned by Lundbeck, that covers a chemical compound known as vortioxetine and a composition of such compound and its use for manufacturing a drug for the treatment of disorders, such as affective disorders (e.g. depression), anxiety disorders (including general anxiety disorder and panic disorder) and obsessive-compulsive disorders, being one of the most important inventions involving the treatment of depression in the last decades. After 4 years of intense work to demonstrate the legality of the patents (notably the presence of novelty, inventive step and descriptive sufficiency), with meetings with the Judge and the Court Expert, the Court Expert, Karla Regina da Silva Gram, presented her report, in December 2024, fully supporting/confirming Lundbeck’s arguments for the validity of the patents. Matter’s Value (specify currency) and/or other key numbers: The amount in dispute is inestimable, but the benefit sought by the client is relevant since the cases involve two patents related to its blackbuster product in Brazil.
