David obtained degrees in Arts (BA) 1989, Law (LLB) 1991 and a Master’s degree (LLM) 1996 specialising in IP Law. Subsequent to qualifying as an attorney of the High Court of South Africa at a well-known firm specialising in IP matters, David and Jean de Chalain founded a niche IP boutique in November 1998. Since then, David has honed his craft culminating in an excess of two decades worth of hands-on experience in the intellectual property arena, with a penchant and particular expertise in trade mark matters. His practice is primarily focused on dispensing considered strategic advice, prosecuting, enforcing and litigating trade mark matters in SA and throughout the African continent.
David has considerable expertise and a wealth of experience in the protection and enforcement of Trade Mark Portfolios owned by International Sports Teams, Supporters Clubs and Championships. He also acts for and behalf of blue-chip and big ticket clients in the sports products, protein powders, energy drinks, nutritional products, entertainment, 4x4, SUV, video game, fashion, horse racing, education, restaurant, craft beer, wine and whisky industries. David relishes challenges by taking on difficult so-called "no-win" cases and prosecuting unconventional trade mark applications through to registration with aplomb. He also has a significant depth of expertise in the consolidation and management of large filing programs, rebranding exercises and Trade Mark Portfolio reviews across the African continent.
Over the last 22 years David has enjoyed and maintained close working relationships with many long-standing clients who value his adroit, prompt attention to their matters with a knack of responding quickly yet thoroughly to complicated queries in a "down to earth" and straight forward manner which is understandable, practical and devoid of "sugar-coating".
Among his accolades, David has from 2016-2020 been recognized by MIP in its Annual World IP Survey based on input from clients and other IP Lawyers (Peers) as a leading individual / "IP STAR" for trade mark litigation, prosecution, strategy and counselling. Moreover in February 2020 World Trademark Review WTR 1000 "the defining go-to resource for those seeking legal trade mark expertise which identifies leading lights in 70 jurisdictions" ranked David as a recommended legal trade mark professional and leading individual for prosecution and strategic advice.
