PETILLION is an independent Belgian IP and dispute resolution boutique combining more than 50 years of experience. PETILLION has a long-standing reputation for handling high profile and complex IP disputes and transactions. We provide a full array of international and domestic IP legal services to assist companies in obtaining, managing, and enforcing IP rights in virtually every technological and commercial field. We excel at handling significant, high value commercial disputes in an efficient, thorough and cost-effective manner across the full range of IP disciplines including patents, supplementary protection certificates (SPV), trademarks, designs, copyrights, top-level domains, domain names and trade secrets.

Our litigation abilities cover the full spectrum of IP disputes. We represent clients in court and in ADR, in both domestic and multi-jurisdictional disputes. We have particular experience in cross-border issues, and in designing and implementing strategies for both national and complex multi-jurisdictional IP disputes. We not only litigate, but also provide counselling on all aspects of IP, including validity, enforcement, freedom-to-operate and infringement issues. We structure, negotiate, and implement IP transactions, including licensing and R&D agreements. We advise on IP portfolio management procedures and design proprietary information protection programmes. We also offer training on IP protection, assist clients in establishing internal policing and enforcement policies, and conduct IP due diligence studies.

Some of our recent successes include:

  • Representing an international producer of cut crystal and genuine gemstones in proceedings before Belgian courts to enforce its European trademark and design rights against counterfeiters;
  • Representing a major Swedish furniture manufacturer in cross-border litigation and ADR proceedings in the enforcement of its trademarks and copyrights;
  • Representing a Belgian publisher in a dispute related to a co-publishing and copyright licensing agreement before the Ghent Enterprise Court and Paris Cour de Grande Instance;
  • Representing a Belgian producer of medical and maternity products in patent re-establishment procedures before the European Patent Office;
  • Representing an international manufacturer of bicycles and top-grade (carbon) sports products in cross-border trademark opposition proceedings before the EUIPO against manufacturers of bicycle components;
  • Assisting a major international chemical company in a contracting and project dispute related to the implementation of enterprise resource planning software (SAP).

PETILLION’s leading position as a highly experienced and specialised boutique law firm for IP and IT matters has been acknowledged in various international ranking guides. For example, the Legal 500 EMEA 2019 determines that PETILLION “is highly regarded for its expertise in IP litigation. The firm's copyright practice, which handles software, content and database protection matters, is another key strength” and that PETILLION “is praised for being comfortable working at the place where IP and digital meet, with a great understanding of issues from GDPR to online anti-counterfeiting.”
