Adam Kelly is a partner in the Patent Litigation and Counselling Department in the Chicago office of Loeb & Loeb LLP and a nationally-acclaimed counselor in intellectual property law with extensive experience in the U.S. and abroad. Outside of the courtroom, Mr. Kelly frequently assists clients with due diligence, strategic procurement of new technologies, and contract and license negotiations. He frequently counsels corporate executives on how to competitively use intellectual property to increase revenues and market share.
Inside the courtroom, Mr. Kelly has successfully enforced and defended against patent infringement actions in various jurisdictions throughout the world. He has represented clients through all litigation phases, from pre-suit due diligence through trial and appeal. He has also successfully obtained and defended against various types of preliminary injunctive relief associated with design and utility patent infringement actions.
Mr. Kelly has represented clients in a wide variety of patent infringement cases in both federal district and appellate courts, with substantial appellate experience arguing and practicing before the U.S. Court of Appeals for the Federal Circuit. Mr. Kelly has also represented clients in prosecution, opposition, and reexamination proceedings before the U.S. Patent and Trademark Office and the European Patent Office.
Mr. Kelly's clients include industry leaders in agricultural science, biotechnology, green energy, and the chemical and pharmaceutical arts, including both branded and generic companies concerning product life cycle management and disputes arising under the Hatch-Waxman Act. His clients also include companies positioned within the computer and electronic arts involving network-based computer systems, graphical user interfaces, and gaming systems.
Mr. Kelly frequently lectures to audiences around the world regarding intellectual property issues, including in China, England, Hong Kong, Taiwan, and the U.S. He is widely recognized as a leader in his field and has been profiled by the National Law Journal as one of Chicago's "40 Under 40" and by Chicago Lawyer among the magazine's "40 Illinois Attorneys Under Forty to Watch." In addition, he has been cited for excellence in the law by Chambers USA and Thomson Reuters' Super Lawyers.
Mr. Kelly received his J.D. from The John Marshall Law School, an M.S. in biology from Purdue University and his B.A. from Indiana University.
