With nearly 20 years of experience in intellectual property law, Tracey Truitt serves clients of all sizes across industries including agribusiness, food, health care, biotechnology and life sciences. He counsels clients on patent and trademark acquisition, licensing, enforcement issues, due diligence, prosecution, litigation, and other general business matters.
A testament to the quality of his work, Tracey has been serving many of his clients for over a decade. Tracey is dedicated to gaining in-depth knowledge about each client's invention and the technology surrounding it, in order to develop strategies and arguments that will impact their bottom line and drive success throughout their product portfolio.
Clients have said that Tracey is extremely skilled at digesting complex situations that involve technology, law, and business considerations and communicating his strategy and rationale in a straightforward, easy to understand format that is appropriate for the audience.
Clients rely on him to develop and implement global patent prosecution strategies, advise them on trade secret issues, assess and guide them on freedom-to-operate issues, provide opinions related to patent invalidity, patent infringement, and patentability, and keep them abreast of changes in patent laws, rules, and significant cases that are relevant to their business and competitors. He has directed and coordinated patent prosecution on a worldwide basis for thousands of patent applications and has developed relationships with leading foreign counsel in Europe, Canada, Australia, Japan, China, Mexico, Taiwan, Brazil, Russia, Argentina, and India. Tracey enjoys taking on the most challenging cases, working with inventors and patent examiners to identify the patentable subject matter, and protecting it to its fullest extent.
To that end, he is a believer in personally presenting arguments to patent examiners through the interview process and visits the Patent Office 4-6 times a year to meet with Examiners.
Tracey was named 2017 "Lawyer of the Year" in Kansas City, Missouri by The Best Lawyers in America ® for Biotechnology Law. He has also been ranked by The Best Lawyers in America ® for Biotechnology Law since 2016, and was named an IP Star by Managing Intellectual Property in 2016.
